Road Maintenance Agreement for Mountain View Lane and Forest Lane

TFBC Corporation Responsibilities:

  1. To maintain the integrity of the road surface (repairing significant cracks, repaving, etc.),

  2. To keep the ditches clear of debris and brush as necessary insuring the unimpeded flow of water runoff.

  3. To keep brush cut back as necessary five to seven feet from the edge of each side ofthe paved roadways which is TFBC owned road right of way (This may have to include property owner plantings.)

  4. To trim back overhanging tree branches as necessary to provide a minimum of twelve feet of clearance above the road surface.

Property Owner Responsibilities:

  1. To keep culverts under the property owner's driveway(s) clear of debris, roots and trash, insuring the unimpeded flow of runoff water. Culvert pipes should be of adequate size per Mason County regulations for driveway approaches.

  2. To keep the ditches clear of debris caused by the property owner's activities (earth moving, landscaping, etc.).

  3. To prevent root damage to the road surface and road bed by tree removal, etc. as necessary.

  4. To keep trees, shrubbery and brush cut back so it does not encroach on the TFBC roadway and right of way.

  5. Any work done in the TFBC road right of way shall require prior approval of the board of directors. Per Article lX #5 of the protective covenants, no building is authorized within 20 feet of the street right of way.

*** Property owners who do not comply with the above will be issued one warning letter, followed by the normal fine schedule. ln those cases where it becomes necessary, the Board will arrange for a contractor to make the correction and then charge the property owner.
